    Terms of Service

    These Terms of Service govern your use of the website diabeticbuybackprogram.com and any transaction you conduct with XBC Group LLC, a Colorado limited liability company doing business as Diabetic Buyback Program ("we," "us," or "our"). By submitting a quote request, accepting a quote, or shipping items to us, you agree to these Terms.

    Who can sell to us

    You must be at least 18 years old, a resident of the United States, and the lawful owner of the supplies you are selling. You represent and warrant that:

    1. a.You acquired the supplies lawfully, paid for them out of pocket, and are not selling supplies that were paid for in whole or in part by Medicare, Medicaid, Tricare, the U.S. Department of Veterans Affairs, the Indian Health Service, or any other federal or state program.
    2. b.You are not selling supplies that were billed to a private insurance plan in violation of that plan's terms.
    3. c.You are not a licensed durable medical equipment supplier, pharmacy, or distributor selling on behalf of a business.
    4. d.The supplies are your own personal surplus.

    We may decline any transaction at any time if we have reason to believe a representation above is inaccurate.

    Eligible supplies

    We purchase only:

    1. a.Factory-sealed retail packaging from the original manufacturer.
    2. b.Supplies that have not expired and that meet our minimum-expiration requirement on the date we receive them.
    3. c.Brands and product categories on our current price list. Items not on the price list will not be paid for and may be discarded at our discretion.

    We do not purchase supplies that are opened, resealed, expired, damaged, water-damaged, missing components, or marked with prescription labels that cannot be safely removed without damage to the box.

    Quotes

    Quotes are estimates based on the information you provide. Final payment is calculated after physical inspection at our Colorado facility. If the supplies as received differ from the supplies described in your quote, the final payment will be adjusted accordingly and you will be notified. Quotes are valid for fourteen (14) calendar days from the date issued. Market prices change and we reserve the right to adjust quotes that have not been honored within that window.

    Return shipping

    We provide a prepaid UPS Ground return label for the convenience of the seller under the following tiered policy:

    1. a.For shipments with a quoted value of one hundred dollars ($100) or more, we provide the return label at no cost to the seller.
    2. b.For shipments with a quoted value between fifty dollars ($50) and ninety-nine dollars and ninety-nine cents ($99.99), we provide the return label at no cost as a courtesy, but we reserve the right to deduct the actual shipping cost from the final payment in cases of repeated abuse.
    3. c.For shipments with a quoted value below fifty dollars ($50), the seller is responsible for the cost of shipping.

    All UPS return labels are generated through Shippo, a third-party shipping platform. The label is scanned and charged to us when UPS picks up or accepts the package. Labels that are not used within thirty (30) days will be voided.

    Inspection and payment

    After we receive your shipment, our team inspects each item and reconciles the contents against your quote. Inspection usually takes one (1) business day. Payment is issued within one (1) to two (2) business days after inspection by the method you selected during the quote process (Venmo, PayPal, Cash App, Zelle, ACH direct deposit, or check by mail). Payment timing may be longer for high-volume shipments or in situations requiring additional review.

    Rejection of supplies

    We may reject some or all items in a shipment if they do not meet the eligibility criteria in Section 2. If items are rejected:

    1. a.We will document the reason and notify you by email within three (3) business days of inspection.
    2. b.You may request return of the rejected items within three (3) business days of our rejection notice. Return shipping for rejected items is paid by the seller. If we do not receive a return request within three (3) business days, we will dispose of the items in a manner consistent with applicable safety and environmental rules, at our discretion and at no cost or credit to you.

    Prohibited transactions

    You may not sell to us:

    1. a.Supplies that were obtained through Medicare, Medicaid, Tricare, the Department of Veterans Affairs, the Indian Health Service, or any other government program.
    2. b.Supplies you do not personally own.
    3. c.Stolen, counterfeit, or tampered supplies.
    4. d.Insulin, GLP-1 agonists, or any other prescription drug unless we have published a separate program with eligibility rules for that category.
    5. e.Used sharps, used lancets, used pump sets, or any biohazardous material.
    6. f.Supplies labeled "DME Beneficiary," "Government Payee," marked with a red diagonal line, or otherwise marked as not for resale.

    Selling any of the above is a material breach of these Terms. We may withhold payment, report the transaction to the relevant authorities, and recover any payment previously made.

    Payment methods and tax reporting

    Payment is processed by third-party payment networks. We are required by the Internal Revenue Service to issue Form 1099-K to sellers whose annual payments exceed the then-current federal reporting threshold. You are responsible for reporting income from these transactions on your federal and state tax returns.

    Privacy

    Our handling of your personal information is governed by our Privacy Policy at diabeticbuybackprogram.com/privacy, which is incorporated into these Terms by reference.

    Limitation of liability

    To the maximum extent permitted by law, XBC Group LLC's total liability arising out of or related to these Terms, any transaction, or your use of this website is limited to the amount we paid you for the most recent shipment, or one hundred dollars ($100), whichever is greater. We are not liable for indirect, incidental, consequential, special, or punitive damages.

    Governing law and dispute resolution

    These Terms are governed by the laws of the State of Colorado without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved first by good-faith negotiation. If negotiation fails, the parties agree to binding arbitration administered by the American Arbitration Association in Denver, Colorado, except that either party may bring a claim in small-claims court in Adams County, Colorado, for amounts within that court's jurisdiction.

    Changes to these Terms

    We may update these Terms from time to time by posting a revised version on this page and updating the "Last updated" date. Your continued use of the site or your submission of supplies after a change constitutes acceptance of the revised Terms.
